Participation in the prize draw by THERMOTEX NAGEL GmbH, hereafter referred to as operator or organiser, is free of charge and is based exclusively on these conditions of participation.

Prize draw procedure
The duration of the prize draw 1 is from 25.11.2019, 00.00 a.m. until 01.12.2019, 23.59 p.m.
The duration of the prize draw 2 is from 02.12.2019, 00.00 a.m. until 08.12.2019, 23.59 p.m. 
The duration of the prize draw 3 is from 09.12.2019, 00.00 a.m. until 15.12.2019, 23.59 p.m.
The duration of the prize draw 4 is from 16.12.2019, 00.00 a.m. until 22.12.2019, 23.59 p.m.
The duration of the prize draw 5 is from 25.11.2019, 00.00 a.m. until 24.12.2019, 23.59 p.m.
Within this period, users have the opportunity to participate in the prize draw online.

Participation
In order to participate in the prize draw, the issued participation form must be filled in and sent off. Participation is possible only during the participation period. Entries sent after the participation deadline, are not considered in the draw.

Only one registration sent per participant is entered into the prize draw. It is strictly prohibited to send several e-mail addresses in order to increase chances of winning.

Participation in the prize draw is free of charge.

Persons eligible to participate
Individuals are eligible to participate, who reside in Germany, Austria, Switzerland or France and who are over 18 years of age. Participation is not restricted to the organiser’s customers and does not depend on the purchase of goods or rendering of a service.

In the case that a participant has limited legal competence, the consent of a legal representative is required.

Not eligible to participate in the prize draw are all those persons, who have collaborated in the design and implementation of the prize draw as well as the operator’s employees and their relatives. Furthermore, the operator reserves the right to exclude, at his own discretion, persons from participating when there are legitimate reasons, for example   

(a) manipulations in connection with entering or effecting the prize draw, (b) infringements of these conditions of participation, (c) dishonest practices or (d) false or misleading information in connection with participating in the prize draw.  

Winning, notification and awarding the prize
The following prize is awarded:

• prize draw 1: 1 x 2 Europa-Park admission tickets
• prize draw 2: environmental package (a set of fruit and vegetable nets, eco washing detergent, beeswax cloths, bamboo cutlery)
• prize draw 3: Weissbart & Wildbart: gin & rum 
• prize draw 4: Black Forest package (a rustic wooden chopping board, a knife set, a wooden honey scoop, a wooden mustard spoon, tasty Black Forest honey, various types of mustard from the Black Forest)
• prize draw 5: Voucher for 2 admission tickets for Rulantica

The winners are determined from all participants after the closing of entries by means of a draw based on the random principle. The winner of the draw is promptly informed of the win.

The prize is awarded exclusively to the winner or the legal representative. An exchange, collection by the customer or payment in cash of the winnings is not possible.

The operator shall cover any shipping costs. Any additional costs due to claiming the winnings are borne by the winner. Possible taxation of the winnings is the winner’s responsibility.

If a winner does not respond within a period of 3 weeks after having been prompted twice, then the prize can be transferred to another participant. 

End of the prize draw
The operator expressly reserves the right to end the prize draw without prior notification or without giving reasons. This applies especially to any reasons, which would disrupt or impede the planned process of the prize draw.

Data protection
To participate in the prize draw, personal data needs to be entered. The participant declares that the information given with regards to his/her person is true and correct, in particular their first name, surname and address.

The operator points out that none of the participant’s personal data shall be passed on to third parties, nor given to them for their use, without consent.

In the case of winning, the winner declares his consent to the publication of his name and residential area in the advertising media used by the operator. This includes the publication of the winner on the operator’s website and social media platforms.

The participant can revoke his consent with future effect at any time. The revocation must be addressed in writing to the operator’s contact data stated on the imprint section of the website.

Applicable law
Questions or complaints in connection with the prize draw must be addressed to the operator. Contact data is listed in the imprint section of the website.

The operator’s prize draw is subject exclusively to the law of the Federal Republic of Germany. Recourse to the courts is not permitted.

Severance Clause
If provisions of these conditions of participation be or become ineffective in their entirety or in part, then the validity of the remaining conditions of participation remain unaffected. Instead of the ineffective provision, the legally permissible provision shall apply, which comes closest commercially to the intended spirit and purpose of the ineffective provision. The corresponding applies in instances of a loophole in the regulations of these conditions of participation.
